NEWS FLASH: "VICTIMS" Are NOT in Control of Assault Prosecutions
A common occurrence I see is an assault defendant believing the State will drop charges because the "victim" signed an affidavit of nonprosecution or spoke to someone at the DA's office and expressed they won't show up for prosecution. Here is the reality- cops make probable cause decisions for arrest. Cops get sick of being called to "stop an argument." Generally speaking, the quickest way I have seen cops stop harassment (being constantly called out for what is not their job) is to make an arrest. Assaults are generally she said/he said. All it takes is someone saying they experienced pain. There does not have to be blood or a mark. "Victims" that are so quick to call the cops over a disagreement and then try to control the narrative generally do not do well in the court system. Cops are not therapists.
